When real estate is sold, it is essential that the buyer know exactly what they are purchasing. As a result, the seller must disclose everything they know to be true about the property before the contract is executed and escrow is closed. The law requires that sellers disclose all material facts that affect the value or desirability of the property; when a non-disclosed issue is discovered, it opens up potential liability for the seller, the seller’s agent, and potentially even the buyer’s agent.

Non-disclosure disputes are the most common real estate legal dispute in California, so it is imperative that the larger real estate community understand disclosures.
